By using the services provided by PAINT POET, you agree to the following terms and conditions:

1. General Agreement

These Terms of Service govern your access to and use of the PAINT POET website, AI generation tool, and the purchasing of custom oil paintings. By completing a purchase or using the services, you confirm that you accept and agree to these terms.

2. Service Description

PAINT POET offers the following services:

  • AI-Generated Artwork: Users can upload digital images or descriptions, which our AI tool will convert into AI-generated oil paintings.

  • Custom Oil Paintings: After generating AI art, users can purchase a physical oil painting of the artwork, which is hand-painted by our skilled artists.

  • Curated AI Generation Service: For more personalized artwork, users may opt for our Curated AI Generation service, where our artists manually curate and refine the AI-generated artwork.

3. Copyright and Ownership

  • AI-Generated Artworks: When you upload your artwork, you confirm that you own the copyright to the image you upload or have the necessary rights to use it. PAINT POET will not be held liable for any copyright infringement resulting from the submission of unauthorized images.

  • Ownership of AI-Generated Paintings: You retain full ownership of the rights to the AI-generated paintings created through PAINT POET. You are free to use the artwork for personal, commercial, or promotional purposes, subject to the guidelines specified in these terms.

  • Use of Image by PAINT POET: PAINT POET may use the AI-generated artwork for promotional purposes (e.g., on the website, social media) but will always credit you as the creator.

4. Return and Refund Policy

Since each artwork is custom-generated and hand-painted based on your unique request, PAINT POET does not offer returns or exchanges for AI-generated art or physical oil paintings once the order has been placed.

  • AI Art: After receiving the AI-generated preview, you may request modifications, but once the physical painting is finalized and shipped, it cannot be returned.

  • Damaged or Defective Artwork: If your physical oil painting arrives damaged or defective, please contact PAINT POET within 7 days of receiving the item. We will work with you to resolve the issue by offering a replacement for defective items.

  • Customization Adjustments: You may request changes to the digital preview before finalizing the order, but any changes after the physical painting has been created may not be possible.

5. Payment and Pricing

  • Pricing: The prices for the AI-generated artwork and physical oil paintings are as listed on the website at the time of your order. Prices may change at any time, but changes will not affect orders already placed.

  • Payment: Payments for custom artwork must be completed at the time of order. PAINT POET accepts payment via major credit cards, PayPal, and other approved methods.

6. Use of AI Tool

  • AI Generation Tool: By using the AI generation tool on the website, you agree to use the service for lawful purposes only. You are responsible for the content you upload or describe, and you must ensure that the image or description you provide does not violate any third-party rights, including copyright or trademark rights.

  • AI Tool Limitations: The AI tool generates art based on the data provided by the user. Paint Poet does not guarantee a specific artistic outcome or style but will ensure that the result reflects your input as closely as possible.

7. Delivery and Shipping

  • Shipping Time: Once your custom painting is finalized, it will be hand-painted by our artists. This process typically takes 2-4 weeks. Shipping times will vary depending on your location.

  • Shipping Costs: Shipping costs will be calculated at checkout and vary based on the size and delivery destination of the painting.

8. Account and Security

  • Account Creation: To use the services of PAINT POET, you may be required to create an account. You are responsible for maintaining the confidentiality of your account details and for all activities that occur under your account.

  • Security: We take reasonable measures to protect your personal data and payment information. By using our services, you agree to the collection and use of your information in accordance with our Privacy Policy.

9. Limitation of Liability

PAINT POET is not responsible for any direct, indirect, incidental, or consequential damages arising from your use of the service. We will not be liable for any errors or delays in the creation or delivery of artwork, nor for any damage to the artwork that occurs after delivery.

10. Modifications to Terms of Service

PAINT POET reserves the right to modify these Terms of Service at any time. Any changes will be posted on the website, and your continued use of the service constitutes acceptance of the updated terms.

11. Governing Law

These Terms of Service are governed by the laws of Hong Kong. Any disputes arising from the use of the service will be subject to the jurisdiction of the courts in Hong Kong.
